BMC Software, Inc. is a software vendor. The Company provides system management, service management and automation solutions primarily for large enterprises. Its portfolio of software solutions spans mainframe and distributed systems, applications, databases and information technology (IT) process management functions. BMC Software also provides its customers with maintenance and support for its products and perform services for software implementation, integration, IT process design and re-engineering and education. The Company is organized into two software business segments: Enterprise Service Management (ESM) and Mainframe Service Management (MSM). In June 2008, the Company completed the acquisition of ITM Software. In August 2009, the Company acquired MQSoftware, which operates in the middleware management and enterprise application transaction management markets.

AK Steel Holding Corporation (AK Holding) is a producer of flat-rolled carbon, stainless and electrical steels, and tubular products through its wholly owned subsidiary, AK Steel Corporation (AK Steel). The Company?s operations consist of seven steelmaking and finishing plants located in Indiana, Kentucky, Ohio and Pennsylvania that produce flat-rolled carbon steels, including coated, cold-rolled and hot-rolled products, and specialty stainless and electrical steels that are sold in slab, hot band, and sheet and strip form. The purpose of the Trust is to directly and indirectly explore for, develop and hold interests in petroleum and natural gas properties, through investments in securities, royalty units, net profits interests and notes issued by subsidiaries of the Trust. The activities of Pengrowth Corporation (the Corporation) and its subsidiaries are financed by issuance of royalty units and interest bearing notes to the Trust and third party debt. Swift Energy Company is engaged in developing, exploring, acquiring, and operating oil and natural gas properties, with a focus on oil and natural gas reserves onshore and in the inland waters of Louisiana and Texas. During the year ended December 31, 2008, the Company completed the selling of its New Zealand-based operations. In 2008, the total proved reserves for the Company was comprised of approximately 43% crude oil, 42% natural gas, and 15% natural gas liquids (NGLs); and 53% of the total proved reserves were proved developed. The proved reserves are concentrated with 61% of the total in Louisiana, 38% in Texas, and 1% in other states. The Company focuses its development and exploration in four areas: Southeast Louisiana, South Texas, Central Louisiana/East Texas and South Louisiana.
Newfield Exploration Company is an independent oil and gas company engaged in the exploration, development and acquisition of natural gas and crude oil properties. The Company?s areas of operation include the Anadarko and Arkoma Basins of the Mid-Continent, the Rocky Mountains, onshore Texas and the Gulf of Mexico. During the year ended December 31, 2008, the Company had proved reserves of 2.95 trillion cubic feet equivalents (Tcfe). Those reserves were 72% natural gas and 62% proved developed.
The Permian Basin Royalty Trust (the Trust) is an express trust. The net overriding royalties conveyed to the Trust (the Royalties) include a 75% net overriding royalty carved out of Southland Royalty?s fee mineral interests in the Waddell Ranch in Crane County, Texas (the Waddell Ranch properties), and a 95% net overriding royalty carved out of Southland Royalty?s major producing royalty interests in Texas (the Texas Royalty properties).
Vectren Corporation (Vectren) is an energy holding company. The Company?s wholly owned subsidiary, Vectren Utility Holdings, Inc. (Utility Holdings), serves as the intermediate holding company for three operating public utilities: Indiana Gas Company, Inc. (Indiana Gas), Southern Indiana Gas and Electric Company (SIGECO) and the Ohio operations (VEDO). Utility Holdings also has other assets that provide information technology and other services to the three utilities. Indiana Gas provides energy delivery services to over 568,000 natural gas customers located in central and southern Indiana. SIGECO provides energy delivery services to over 141,000 electric customers and approximately 111,000 gas customers located near Evansville in southwestern Indiana. Anadarko Petroleum Corporation (Anadarko) is an independent oil and gas exploration and production company with 2.28 billion barrels of oil equivalent (BOE) of proved reserves as of December 31, 2008. The Company operates in three segments: oil and gas exploration and production, which explores for and produces natural gas, crude oil, condensate and natural gas liquids (NGLs); midstream, which is engaged in gathering, processing, treating and transporting Anadarko and third-party oil and gas production, and marketing, which sells most of Anadarko?s production, as well as commodities purchased from third parties. In December 2008, Anadarko completed the sale of its 50% interest in the Peregrino heavy-oil field offshore Brazil to StatoilHydro. In 2008, the Company divested certain oil and gas properties, primarily in Brazil, onshore in the United States and the Gulf of Mexico.

As of December 31, 2008, the Fund?s assets consisted of securities issued by its direct wholly owned subsidiaries, and 95%, 99% and 99% royalties on the crude oil and natural gas property interests of EnerMark Inc., Enerplus Resources Corporation (ERC) and Enerplus Oil & Gas Ltd. (Enerplus Oil & Gas), respectively. As of December 31, 2008, the Fund?s material Operating Subsidiaries were EnerMark, ERC, Enerplus Commercial Trust (ECT), means Enerplus Resources (USA) Corporation (Enerplus USA) and FET Operating Partnership. On February 13, 2008, the Fund completed its acquisition of Focus Energy Trust (Focus). On July 31, 2008, Enerplus completed the sale of its 15% working interest in the Joslyn oil sands lease to Occidental Petroleum Corporation.
Hugoton Royalty Trust (the Trust) is an express trust created under the laws of Texas pursuant to the Hugoton Royalty Trust Indenture entered into on December 1, 1998 between XTO Energy Inc., as grantor, and NationsBank, N.A., as trustee. Bank of America, N.A. succeeded NationsBank as the trustee of the Trust. XTO Energy conveyed to the Trust 80% net profits interests in certain natural gas producing working interest properties in Kansas, Oklahoma and Wyoming under three separate conveyances. In exchange for these net profits interest conveyances to the Trust, 40 million units of beneficial interest were issued to XTO Energy. XTO Energy distributed all of its remaining 21.7 million trust units. As of December 31, 2008, XTO Energy is not a unitholder of the trust. The net profits interests entitle the Trust to receive 80% of the net proceeds from the sale of oil and gas from the underlying properties.

The Company manages three global product families: Donor, which markets blood and plasma collection devices, consumables and other business solutions; Patient, which markets into hospitals surgical blood salvage and blood demand diagnostic devices and consumables, as well as blood management services, and Software Solutions and Services, which markets information technology platforms and consulting services to blood and plasma collectors and hospitals. In March 2009, the Company acquired Altivation Software and its primary product, Hemasphere. Hemasphere is a software system focused on mobile blood drive management.
